Fraud Remedies and Risks in Government Contract Litigation

The Government has various statutory remedies at its disposal to combat procurement fraud, including the False Claims Act, the anti-fraud provision of the Contract Disputes Act, the Special Plea in Fraud, and the Anti-Kickback Act. This program will provide an overview of these remedies, procedural and other considerations related to their enforcement in litigation, and recent cases and developments. The program will include discussion of:
(1) the most common causes of action available to the government to combat fraud and their elements and burdens of proof (False Claims Act (FCA), the anti-fraud provisions of the Contract Disputes Act, Anti-Kickback Act, Special Plea in Fraud, etc.)
(2) procedural and jurisdictional issues related to fraud allegations that arise in various fora, including the U.S Court of Federal Claims and boards of contract appeals, including parallel proceedings;
(3) new cases and emerging issues in procurement related FCA and fraud cases, including recent cases before the Armed Services Board of Contract Appeals and cybersecurity enforcement under the FCA.
