Fraud Remedies and Risks in Government Contract Litigation

The Government has various statutory and common law remedies at its disposal to combat procurement fraud, including the False Claims Act, the anti-fraud provision of the Contract Disputes Act, the Special Plea in Fraud, and the Anti-Kickback Act. This program will provide an overview of these remedies, procedural and other considerations related to their enforcement in litigation, and recent cases and developments. The program will include discussion of:
(1) burdens of proof and procedural and jurisdictional issues related to fraud allegations that arise in various fora, including the Court of Federal Claims and boards of contract appeals;
(2) False Claims Act enforcement against subcontractors and other third parties, and
(3) fraud issues in parallel proceedings involving contract disputes.
