HOW – A Hands-On Workshop to Help You Pre-Identify and Legend Proprietary Technical Data and Software

Understanding technical data and computer software regulations is one of the most challenging steps in contracting with the U.S. Government. An often overlooked – and one of the most important – facets of working with data and software is how best to mark and protect your intellectual property assets. Failure to mark your IP properly, with the appropriate restrictive legends, can lead to forfeiture of your IP rights. This class will explore not only how to understand the myriad of IP regulations regarding data and software protection, but also how to properly and effectively mark all of your data and software to avoid inadvertant disclosure to the U.S. Government or any third parties. We will examine, among other topics, (i) various types of restrictive legends and licensing approaches; (ii) a host of real-world examples of how best to mark drawings, specifications and software; and (iii) how to implement steps within your company to manage successfully data and software that is going to be delivered to the U.S. Government.
