Our February 2 session of The Case of the Month Club will feature two GAO protest decisions and one ASBCA decision. Our panelists will discuss Ortho-Clinical Diagnostics, Inc., B-418946, Oct. 23, 2020, 2020 CPD P 331, a case involving an RFQ in which the protester learns a hard lesson about the perils of relying on technology, and Master Pavement Line Corp., B-419111, Dec. 16, 2020, 2020 CPD P 404, a rare GAO decision involving an IFB and reminding all of us of the important differences between responsiveness and responsibility in a sealed-bid procurement. Our panelists will also discuss the ASBCA’s decisions in Aerospace Facilities Group, Inc., ASBCA No. 61026, 20-1 BCA P 37668, a default-termination case with several dimensions worth considering. As always, we will send copies of the decisions to you before the program, and we strongly recommend that you read them in order to get the most out of our discussion. Because the Case of the Month Club will look at recent cases based on their importance to Government Contracting, we will set the class’s Topic several weeks prior to the program. This will help keep the program fresh.
