Our August Case of the Month Club program will actually cover two recent decisions, one a claim and the other a bid protest. In BGT Holdings v. United States, the U.S. Court of Federal Claims dealt with a case in which a Government agency failed to deliver the Government Furnished Property it had promised the contractor, a situation that gave rise to a host of issues. Our bid protest discussion will focus on the GAO’s recent opinion in M.C. Dean, B-418553, a case dealing with the very tricky issue of changes that occur with an offeror’s key personnel between the time the offer is submitted and the date of award. We will send each of the full decisions out to you prior to the program, and we strongly encourage you to read both decisions beforehand in order to get the most out of our discussion. We look forward to having you with us for this timely and provocative discussion.
