Case of the Month Club

The December 1 Case of the Month Club program will once again include discussions of both a bid protest and a contract claim. For the bid protest, our experts will discuss the U.S. Court of Federal Claims’ recent decision in Bluewater Management Group LLC v. United States, No. 20-1160C, 2020 WL 6733768 (Oct. 29, 2020). The decision demonstrates that the court will in fact take a hard and penetrating look at an agency’s evaluation process and that, with the right administrative record, the court will not hesitate to order corrective action. The case also shows how differences in the record before GAO and the court can lead to very different outcomes. The claims case is the Armed Services Board of Contract Appeals’ recent decision in Alistiqama Co., ASBCA Nos. 62501 and 62502, Oct. 27, 2020, where it appears that cultural differences could have led to the appellant’s undoing and where the board clearly explains the effect of a properly-prepared release document. Would the pro se appellant have fared any better if it had been represented by competent counsel? Join us to hear what our experts have to say on December 1—it will be a very lively discussion.
