Implementation of 889a(1)(B) – Representation Regarding Certain Telecommunications and Video Surveillance Services or Equipment

On July 14, 2020 the FAR Council published an Interim Rule implementing §889a(1)(B) of the FY19 National Defense Authorization Act. This is the second for two provisions in the statute which prohibit the use of products of certain Chinese companies. The first of the provisions §889a(1)(a) prohibited delivering goods and services using from the identified companies to the government and became effective 13 August 2019. The second provision, §889a(1)(b), the subject of this webcast, covers the use of products or services from the identified Chinese companies in performing work by government contractors, including back office functions. The second provision becomes effective on 13 Aug 2020.
The articulated purpose of both provisions is to reduce the theft of intellectual property by China and to protect Federal systems from infiltration of US systems by China. These provisions will apply to all government contracts, regardless of dollar value and regardless of whether a commercial product or service is being sold/purchased.
