Liquidating Damages Webinar

On April 16, 2020, attorneys from Seyfarth Shaw’s Construction and Government Contracts practice group will be presenting a 90-minute webinar discussing the best practices for managing claims made by subcontractors on public procurement projects. The webinar will consist of three 30-minute segments. First, Michael Wagner will discuss the relevant Federal Acquisition Regulation clauses that apply to subcontractor claims and the best practices for compliance with those provisions. Teddie Arnold will then provide an overview of the possible avenues for pursuing subcontractor pass-through claims against the Government under the Contract Disputes Act. In the final segment, Anthony LaPlaca will discuss the key issues that arise when negotiating liquidating agreements for subcontractor claims that arise out of the acts or omissions of the public owner.

Learning Objectives

Attendees at this seminar will learn:
• Which Federal Acquisition Regulation (FAR) clauses are relevant to government subcontractors and the best practices for ensuring that subcontractors comply with those clauses;
• The Contract Disputes Act process for vetting, preparing and, where appropriate, passing through subcontractor claims to the public agency; and
• The key issues that arise during negotiations for a liquidating or joint prosecution agreement and how such issues are most commonly resolved between the general contractor and subcontractor claimants.
