During this session of PCI’s 2024 Financial Forum, we will begin with a discussion of the contours of the regulations and guidance that should inform a contractor’s evaluation of cost allowability and reasonableness and will conclude with a review of recent updates to the cost allowability and reasonableness regulatory and case law landscape. - March 4 – Select Cost Principles: Compensation, Travel, Legal, and Related Costs (Mike Mardesich)
This webinar will address the allowability of employee compensation, travel, legal and related costs in federal cost-reimbursement contracts under FAR Part 31. The webinar will review recent government audit trends and relevant decisional authority. This program will provide contractors helpful information about how to effectively meet the requirements for effective disclosure of Truthful Cost or Pricing Data. It will discuss the requirements for adhering to the Truthful Cost and Pricing Data statute, including when the statute applies, what constitutes cost or pricing data, and when subcontractors must also disclose cost or pricing data. The program will also touch on the elements of and defenses to a defective pricing claim. The course will conclude with a discussion of best practices for government contractors seeking to avoid liability for defective pricing. - July 1 – Getting Paid – Contract Financing and its Challenges (Brian Gallagher)
This session will address the regulatory framework around payment terms and billing structures that apply to various contract types, including but not limited to performance-based payments, progress payments, and cost vouchers. We will also delve into the practical challenges that arise in the normal course of business with the government customer that can affect timely payment. Understanding the nuances of invoicing instructions, accumulating required program performance information, or navigating the details of 52.216-7 Allowable cost and payment can all have impacts on contract financing. This program will identify some common pitfalls and best practices to achieve timely payment for contract performance. - September 2 – Pricing Requests for Equitable Adjustments and Pursuing Claims (Brad Tress)
This presentation will provide an introduction to requests for equitable adjustments (REAs) and claims under federal government contracts. The webinar will first provide an overview of the contract disputes process, the difference between REAs and claims, and basic entitlement theories. The webinar will then turn to certain pricing considerations, including considerations for deleted work, overhead, profit, as well as entitlement considerations. Finally, the presentation will cover latest developments on these subjects and best practices for government contractors. - October 7 – Developments in Cost and Pricing: A Year in Review (Bill Walter)
