Thank you for joining us for another great episode of FUN with the FAR! Episode 19 covered: FAR Part 33 (Protests, Disputes, and Appeals). As a follow-up to Wednesday’s session, here are a few facts to ponder as we prepare for our next session of Fun with the FAR:

 

DID YOU KNOW?

For purposes of FAR Part 33, the word “day” means “calendar day.” FAR 33.101.

 

DID YOU KNOW?

Agency level protests are defended by agency legal counsel and are often decided by the procurement contracting officer. Contractors are entitled to request an independent review of an agency level protest at a level above the contracting officer. FAR 33.103(d)(4).

 

DID YOU KNOW?

GAO protests are defended by agency counsel and are decided by an “attorney advisor” who is employed by the GAO.

 

DID YOU KNOW?

A protester is required to furnish a copy of its complete GAO protest to the agency official and location designated in the solicitation or, in the absence of such designation, to the contracting officer, so it can be received no later than 1 day after the protest is filed with the GAO. FAR 33.104(a); see also FAR 52.233-3 (Protest After Award clause).

 

DID YOU KNOW?

FAR Part 33 applies to all disputes with respect to contracting officer decisions on matters “arising under” or “relating to a contract.” FAR 33.203(c).
