Public Contracting Update Symposium

The Public Contracting Institute (PCI) is pleased to invite you to the annual public contracting update. Please join us for an opportunity to hear from government and industry executives about a range of issues, including the current DCAA/DCMA environment, compliance matters, cybersecurity matters, and supply chain isuues. We will also discuss the impact of business systems requirements in today’s marketplace and the latest legal updates that pertain to government contractors.
Day One: November 1, 2022
Session 1: 10:00 am – 11:30 am (ET) Legal Update
Each year, the boards, the court of federal claims, and the GAO decide hundreds of cases impacting government contractors. Each case provides additional insight into the law surrounding government contracting. Some cases are a watershed moment that significantly change government contracts law. During this first 90-minute session, we’ll dive into the most important claims and bid protest cases we’ve seen in the past year. We’ll explain what was at issue, how the case was resolved, and what contractors need to do in light of these new developments. We will close out the session with a discussion of where we see the law evolving into the future.

Session 2: 12:00 pm – 1:30 pm (ET) Cost & Pricing Developments and Dealing with Inflation
While cost and pricing in the federal contracting marketplace is already unique and challenging, today’s pricing environment is in turmoil due to:
  • Oversight officials requiring information beyond just certified cost/pricing data for commercial items and services;
  • New expectations for pricing realistic escalation factors in proposals and negotiations; and
  • The use of economic price adjustment (EPA) clauses and requests for equitable adjustment to consider the impact of inflation, causing concerns for the DIB and the government in regards to the ability of contractors to continue to provide goods and services at the prices negotiated years ago.
Our panelists will cover these topics and other relevant cost and pricing issues. In addition, the team will answer attendees’ questions associated with negotiating contract prices.

Session 3: 2:00 pm – 3:30 pm (ET) Domestic Preferences and Other Sourcing Restrictions
Domestic Preferences is arguably the area of government contracts that has seen the largest evolution in the past 5 years. The Buy American Act has seen a dramatic increase in its scope and the Buy America rules are currently undergoing significant adjustments due to the recent passage of the Infrastructure Investment and Jobs Act of 2021 and associated agency guidance. During the 3rd session of the symposium, we will summarize the key changes in this area of government contracts and the impacts on the contractor community.

Session 4: 10:00 am – 11:30 am (ET) Incurred Cost Proposals – Hot Topics and Recent Developments

  • The proper treatment of PPP forgiven loan amounts
  • The potential changes to the ICP schedules

Session 5: 12:00 pm – 1:30 pm (ET) Purchasing Reviews with DCMA Representative
Contractor Purchasing System Reviews (CPSR) remain an integral part of oversight of contractors by the Government. This panel will discuss the following:
  • The importance of addressing the requirements of the DCMA CPSR guidebook in your purchasing system
  • The recent government changes related to commercial item determinations
  • Cost/price documenting expectations
  • How to navigate and prepare for a CPSR 
  • The recent CPSR trends and findings

Session 6: 2:00 pm – 3:30 pm (ET) Estimating, Accounting & Material Management (MMAS) with DCAA Representative
The DCAA is responsible for the oversight of three of the six business systems spelled out in the DFARS. Since the DCAA has modernized itself on incurred cost audits, the agency hasbeen applying their available resources to complete other initiatives such as business system reviews. Our panelists will discuss the role of the DCMA and DCAA in these reviews, updates to the related audit programs, and will provide insight into what issues contractors are commonly facing and the steps they take to ensure a successful outcome.

Day Three: November 3, 2022
Session 7: 10:00 am – 12:00 pm (ET) Everything Cybersecurity: CMMC, NIST 800-171, Cyber Assessment, and More
Cybersecurity is a critical element in the protection of our national security. DoD contractors have been subject to clauses such as DFARS 242.204-7012 for many years and the ominous CMMC 2.0 guidance is currently being drafted by the government. In addition, there is new guidance currently being released that will provide new cyber requirements for FAR based contracts. Our panel consisting of cyber professionals will discuss the following topics:
  • CMMC and NIST 800-171
  • DoD cybersecurity assessment framework
  • Controlled unclassified information
  • Incident handling 
  • Cybersecurity best practices
