Case of the Month 2021

Everyone we know loves a bonus, so here is what we have in store for you next week:  PCI’s Case of the Month Club will kick-off the New Year with a discussion of three recent decisions—a bonus for everyone!  Two of the decisions (JAF Supply, Inc. v. Dept of Veterans Affairs, CBCA 6934, 2020 WL 6817693 (Nov. 16, 2020); and Miami-Dade Aviation Department v. General Services Administration, CBCA 6689, 2020 WL 6818754 (Nov. 12, 2020)) will deal with jurisdictional defects that can be fatal before the boards of contract appeals.  In each case, the defects were eminently avoidable, but the CBCA’s decisions remind us of the need to turn square corners when dealing with the Government.  Our protest discussion will focus on the GAO’s recent decision in Qbase, LLC, Perspecta Enterprise Solutions, LLC and Northrop Grumman Systems Corp, B-416377.9, et al, Nov. 13, 2020, 2020 CPD P 367, in which the GAO dissects the Department of Justice’s actions in evaluating proposals for a $4.5 billion multiple-award, IDIQ procurement, ultimately sustaining the protests on the ground that the agency’s best-value determination was overly-mechanical.  The decision has a number of twists and turns, and our panelists will have a lot to discuss.  We hope you can join us on January 5, and we also hope you will read the decisions in advance—an exercise that will greatly enhance what you can take away from our program.

Because the Case of the Month Club will look at recent cases based on their importance to Government Contracting, we will set the class’s Topic several weeks prior to the program.  This will help keep the program fresh.
