Companies’ broad diversity and inclusion efforts have taken off but legal risks loom for government contractors, including exposure to liability under the False Claims Act (FCA). Breakdowns in practices and policies like implementing hiring quotas or conducting sham interviews to fulfill obligations have garnered the attention of federal officials. In addition, new federal agency requirements requiring companies to certify that they have developed and maintained compliant affirmative action programs are among several labor and empoyment-related legal obligations that present heightened enforcement risks for government contractors, particularly under the FCA. In this presentation, Perkins Coie attorneys Chris Wilkinson and Alexander Canizares will provide an overview of the guardrails for contractors’ diversity and inclusion efforts, detail emerging Department of Labor and Equal Employment Opportunity (EEO) requirements for government contractors and highlight False Claims Act settlements and cases that highlight key risk areas for companies. They will also address practical steps that companies can take to reduce their exposure to administrative and enforcement penalties associated with EEO requirements.
