Identifying Risks in Your Foreign Supply Chain

As demonstrated by President Biden’s February 24, 2021 Executive Order on America’s Supply Chains, supply chain security is an increasingly important topic for the U.S. government. But where supply chains inevitably source products from around the world, it is hard to know what we must do to make our supply chains “secure,” recognizing that this task is made even harder when we try to anticipate future policy shifts. This 6-part series is designed to give you an overview of the key issues that you should be considering when working with your foreign suppliers. The discussion topics will draw from current events and recent regulatory updates to give you the knowledge you need to better manage – and better anticipate – the risks in your foreign supply chain.

Topics & Dates

  1. July 19: New Rules and Restrictions In Foreign Supply Chains
    1. Topics will include a discussion of the Federal Acquisition Supply Chain Security Act of 2018 (FASC), and what this means for government contractors. We will also discuss other supply chain restrictions, including Section 889 (relating to the prohibition of certain Chinese-made telecommunications equipment) and other prohibited sources
  2. August 16: Buy American Act requirements (as updated in January 2021) 
    1. Topics will include discussion of new January 2021 Buy American Act requirements and Buy American updates under the Biden administration, including the push to grow the U.S.-based semiconductor industry to allow for greater supply chain security.
  3. September 20: Trade Agreements Act 
    1. Topics will include discussion of the Trade Agreements Act, including how the TAA has evolved over the last 5 years. We will also include a discussion of key free trade agreements, such as the U.S.-Mexico-Canada Agreement (USMCA), and how free trade agreements might evolve under the Biden administration.
  4. October 18: U.S. Export Control Laws and Tariffs
    1. Topics will include an overview of U.S. export laws, including the International Traffic in Arms Regulations (ITAR) and the Export Administration Regulations (EAR), which potentially limit business transactions and data sharing with foreign suppliers and customers.
  5. November 15: Corruption/FCPA
    1. Topics will include an overview of U.S. and international anti-corruption laws, including a discussion of recent news stories and “lessons learned” that you can help you glean strategies to ensure that your foreign sales agents stay in compliance with the laws.
  6. December 20: Supply Chain Cybersecurity
    1. Discussion of cybersecurity requirements, generally, but with a specific focus on lessons learned from the Solar Winds hack and how you can improve cybersecurity in your supply chain. We will also talk about emerging issues relating to Internet of Things (IoT) devices/security, and how IoT could compromise your supply chain.
