Bid protests are a reality. They provide bidders a voice and the opportunity to pressure-test, typically through hired bid protest counsel, the Agency’s decision-making. Ideally, bid protests identify and correct prejudicial errors, ultimately enhancing confidence in the integrity of the procurement system. But they also delay and complicate acquisitions, which attracts criticism from agencies, the Hill and industry. This session will cover the reality of bid protests (as opposed to the myths), how and why they are litigated, and under what circumstances they make sense. We’ll also provide clarity on the very short protest timelines and explain why the awardee should always intervene. This preview of our in-depth four-part bid protest series will provide a solid foundation for anyone who may be asked the ultimate question, “Should we protest?”
