2022 Professor’s Forum: Clarifications and Discussions

In negotiated procurements conducted by the U.S. Government, the line between “clarifications” and “discussions” is a source of tremendous confusion, and that confusion is exacerbated by the fact that the GAO and the U.S. Court of Federal Claims approach the issue from different angles.  The problem is compounded by the inconsistent practices that are used once clarifications and discussions commence.  The unfortunate result is that contracting officers often feel hamstrung and contractors often find themselves the victims of an overly-strict interpretation of the regulations.  Perhaps worst of all, the taxpayers don’t receive the benefit of well-conducted negotiations.  Join Professor Ralph Nash and Tim Sullivan on Thursday, Feb. 17, as they discuss these elusive concepts and provide some practical guidance for both contractors and Government personnel alike.  You don’t want to miss this important program!
